The short version: our free plugins are free to use in any music, personal or commercial. Everything you make is yours. Don't resell them. Paid plugins come with their own licence. No warranty.

HOLY SMOKES FREEWARE LICENCE (End User License Agreement), version 2.0

Licensor: Unitar LLC ("we", "us"), which publishes plugins under the HOLY SMOKES name.

This licence covers HOLY SMOKES plugins that we distribute free of charge (at the time of writing:
POTION, CROSSTALK, AQUARIUM, AFTERHOURS and TORTUGA) and the lite versions on our website. A plugin
sold for a fee comes with its own licence, shown before purchase. By installing or using a plugin
you accept this licence.

1. YOU MAY
- install and use the free plugins on any number of your own computers;
- use them to make music, sound and audio for any purpose, personal or commercial. Everything you
make with them is yours. No credit, royalty or attribution is required;
- share the unmodified download link with others.

2. YOU MAY NOT
- sell, rent, sublicense or bundle the plugins (or modified copies) for a fee;
- remove or change copyright notices, or present the plugins as your own work;
- reverse engineer, decompile or disassemble them to make a competing product, except where
applicable law allows you to despite this restriction.

3. OPEN-SOURCE COMPONENTS
The plugins contain third-party open-source components, listed at holysmokeslabs.com/legal/credits.html.
Those components stay under their own licences, which apply to you in place of this agreement where
they grant you more rights. In particular, the VST3 builds include components licensed under the GNU
General Public License, version 3. For those VST3 builds the GPLv3 prevails over any term of this
licence that conflicts with it, and the corresponding source code of the VST3 builds is available
on request at hello@holysmokeslabs.com.

4. THIRD-PARTY MATERIAL
TORTUGA plays samples derived from "Salamander Grand Piano V3" by Alexander Holm
(https://archive.org/details/SalamanderGrandPianoV3), licensed under Creative Commons Attribution
3.0 (https://creativecommons.org/licenses/by/3.0/). The samples have been modified (trimmed,
processed and packaged for TORTUGA). They stay under that licence; the rest of TORTUGA is covered
by this agreement.

5. NO WARRANTY
The software is provided "as is", without warranty of any kind, express or implied, including
merchantability and fitness for a particular purpose. Some plugins can produce very loud output;
keep your monitoring at a safe level.

6. LIMITATION OF LIABILITY
To the maximum extent permitted by law, we are not liable for any indirect or consequential loss,
or for lost data, lost projects or damaged equipment arising from use of the software. Nothing in
this licence limits or excludes liability that cannot be limited or excluded by law, including
liability for intent or gross negligence, for death or personal injury caused by our negligence,
or any rights you have as a consumer that cannot be waived.

7. TERMINATION
This licence ends automatically if you breach it. Then you must stop using the software and delete
your copies. Sections 3 to 8 survive. Music you have already made stays yours.

8. GENERAL
This licence is governed by the laws of the jurisdiction where Unitar LLC is organised, without regard to
its conflict-of-law rules; mandatory consumer protections of your country of residence are not
affected. If a provision is unenforceable the rest stays in force. This is the whole agreement for
the free plugins and replaces earlier versions.
