the website and studio

You may use this website, its browser studio and the visual tools free of charge to listen to, process and export audio and video. Downloads of the plugins are governed by the licence agreement.

your content

You are responsible for the audio, images and video you load and must have the right to use them. Your files stay on your device; we claim no rights to them or to anything you export.

our content

The site design, artwork, mascot, text and software are ours or used with permission and may not be copied except as the licence agreement or the law allows. To report a copyright concern, email hello@holysmokeslabs.com.

acceptable use

Don't attempt to disrupt the site, overload it, scrape it at scale, or use it to distribute malware or content you have no right to share.

health and safety

Audio plugins can be loud. Keep your listening level safe. The site uses flicker, grain and glitch effects styled after old TVs; you can switch the TV effects and motion off in the menu, and the site follows your system's reduced-motion setting. If you are sensitive to flashing images, switch them off before you start.

no warranty, limitation of liability

The site and software are provided "as is", without warranties of any kind. To the extent permitted by law, we are not liable for any indirect or consequential loss or damage arising from their use, including lost work or damage to equipment or hearing. Nothing in these terms limits liability that cannot be limited by law, including liability for intent or gross negligence, for death or personal injury caused by our negligence, or consumer rights you cannot waive.

trademarks

HOLY SMOKES, POTION, CROSSTALK, AQUARIUM, AFTERHOURS, TORTUGA, DEPTHWAVE and IMAGINEFX are names used by Unitar LLC for its products. VST is a trademark of Steinberg Media Technologies GmbH. Windows is a trademark of Microsoft Corporation. Other product names belong to their owners and are mentioned only to describe compatibility; we are not affiliated with them.

changes and law

We may update these terms; the date above shows the current version. These terms are governed by the laws of the jurisdiction where Unitar LLC is organised, as stated in the imprint, without affecting mandatory consumer protections of your country of residence.
